Account and price lists
You need an account to order. Every new account is approved by one of our administrators before it can complete a purchase: until then you can browse the catalogue, but not order.
Depending on your type of business (installer, system integrator, reseller, company, private customer…) we assign your account to a price-list group, which sets the prices and discounts you see. We decide the group, based on the data you give us.
You are responsible for the accuracy of the data you enter, including VAT number, tax code and SDI recipient code, and for keeping your password confidential.
Products and prices
Product pages describe the main features of each item. Images and diagrams are for illustration only; for binding technical data, the manufacturer's data sheets and manuals prevail.
Prices are in euro and exclude VAT, unless stated otherwise. Before you confirm, the checkout summary shows the total including VAT and the shipping cost.
We show the stock availability of every product. If an item you ordered is no longer available, we tell you straight away: you can wait for the supply time or cancel that part of the order, and we refund what you have already paid.
Orders and conclusion of the contract
You order from the cart, choosing address, shipping and payment. Before confirming you see the full summary and can correct any data.
The contract is concluded when we send you the order confirmation by e-mail, with a summary of what you have bought. We keep the order, which you can always find in your account area.
We may refuse or cancel an order with obvious price or description errors, or when payment fails: in that case we let you know and refund what you have already paid.
Payment and invoices
- Advance bank transfer. The first order is always paid this way: you will find the bank details at checkout and in the confirmation e-mail. The goods are shipped once payment has been received.
- Bank receipt (RiBa). For later orders you can ask to pay by RiBa: we enable it if the finance company approves it. With RiBa the goods are shipped straight away.
The website does not accept payment cards. For every order we issue an electronic invoice through the Italian Exchange System (SDI).
Shipping and delivery
Costs, times and countries served are on the Shipping page, and you see the exact cost at checkout before confirming. In short: in Italy €12 + VAT, free over €1,000 excluding VAT; aluminium profiles and diffusers longer than one metre €15 + VAT, and they cannot be shipped abroad. We do not ship to San Marino and Vatican City: goods can be collected from our premises.
On delivery, check the number of parcels and that the packaging is intact. If it is damaged or tampered with, accept the goods «with reservation», writing it on the carrier's document, and let us know within 8 days.
If you choose collection from our premises with your own carrier, collection and transport are at your expense and under your responsibility.
Warranty
If you buy as a professional or a company, the warranty of the Italian Civil Code applies (Articles 1490 and following): defects must be reported within 8 days of discovery, and the warranty lasts one year from delivery. Any additional manufacturer's warranty remains.
If you are a consumer, you have the legal guarantee of conformity of the Consumer Code (Articles 128 and following): we are liable for defects that appear within two years of delivery, and you are entitled to have the product repaired or replaced or, if that is not possible, to a price reduction or to terminate the contract. The defect must be reported within two months of discovery.
For a faulty product, fill in the returns form or contact us: we reply within 3 working days. The product must be returned only after we have approved the return, in its original packaging and complete with all accessories.
Right of withdrawal for consumers
If you are a consumer you can withdraw from the contract within 14 days of the day you receive the goods, without giving any reason (Articles 52 and following of the Consumer Code). The right of withdrawal does not apply to those who buy as a professional or a company.
To withdraw, send us a clear statement at info@agatastore.it, with the order number and the products you are returning. Then send the goods back within 14 days of that statement, intact and in their packaging: the cost of returning them is borne by you.
We refund you within 14 days of the withdrawal, including the cost of standard shipping, using the same means of payment you used. We may withhold the refund until we have received the goods. You are liable for any loss in value caused by handling the product beyond what is necessary to establish its nature and functioning.
Licences for LogicMachine apps are digital content and are governed by the software licence: at checkout you request immediate supply of the licence and acknowledge that, once you receive it, you lose the right of withdrawal.
Use of the website and content
Texts, images, graphics and documents on the website are protected by copyright. You may download and use them for your professional needs related to the products, but not reproduce them on other websites, catalogues or publications without our written permission. Product trademarks belong to their respective manufacturers.
We do our best to keep the information on the website correct and up to date, but it may contain errors: if you are in doubt about technical data, ask us before ordering. Links to third-party websites are provided for convenience, and we are not responsible for those websites.
Liability
We are not liable for damage caused by installing or using the products in a way that does not comply with the manufacturer's instructions and technical standards, nor for carrier delays once the goods have been handed over to the carrier. Towards professionals and companies our liability is limited to the value of the products purchased, except in cases of wilful misconduct or gross negligence. Nothing in these terms limits the rights that the law grants to consumers.
Privacy
We process the data you give us as described in the privacy and cookie notice.
Governing law and disputes
These terms are governed by Italian law. Disputes with professionals and companies fall under the exclusive jurisdiction of the Court of Cremona. Disputes with consumers fall under the court of the place where the consumer resides.
If we change these terms, we publish the new version here: each order is governed by the version in force when you confirm it.
