Software licence

The holder of the licensing rights on the apps is Agata Automation S.r.l., Via Trioni 14 - 26032 Ostiano (CR), Italy, VAT and tax code 01665440192 ("Agata Automation"), which sells them on agatastore.it. Whoever buys a licence is "the customer".

The app can be downloaded for free from the product page by registered customers: without a licence it installs but controls nothing. What you buy is the licence, a file (license.dat) that unlocks the app on one LogicMachine, the one identified by the fingerprint you send us after buying.

• Perpetual: it does not expire, for the version of the app you have and for the updates published within the same major version (for example, from 1.0 to 1.9).
• Non-exclusive and tied to the controller: it cannot be moved to another LogicMachine. If the controller fails and has to be replaced, write to us with the order number: we will consider a replacement licence.
• You may use the app for your own installations or, if you are an installer or integrator, for your clients' installations, one licence per controller.

• copying, distributing, selling, renting or transferring the app or the licence to third parties, except together with the LogicMachine it is active on;
• modifying, decompiling or reverse engineering the app, except to the extent the law allows it regardless;
• bypassing or disabling the licence check, or using the same licence on more than one controller;
• removing references to the right holder and the authors from the app.

The app remains the property of its right holders: the licence grants its use, not its ownership.

New versions are downloaded from the product page. Updates within the same major version are included in the licence; a new major version (for example 2.0) may require a new licence, and we say so on the product page before you download it. For support, write to info@agatastore.it with your order number.

The app controls real loads — lighting, HVAC, irrigation, alarms — following the calendars you configure. It works if the controller is on, connected to the Internet and able to reach the calendars, and if it is configured correctly: checking the configuration and the behaviour of the installation is the installer's responsibility. Do not use the app as the only control of safety functions (fire protection, personal safety, systems health depends on): those require dedicated devices and standards.

Towards professionals and businesses, Agata Automation is not liable for indirect damage, loss of profit or damage caused by calendars, configurations, networks or third-party services, and its liability for the app is limited to the price paid for the licence, except in cases of wilful misconduct or gross negligence. Nothing in this licence limits the rights the law grants to consumers.

If you are a consumer, the licence is digital content supplied without a tangible medium. At checkout we ask you to expressly request that the licence be supplied immediately after payment and to acknowledge that, once you receive it, you lose the right of withdrawal (Italian Consumer Code, art. 59(1)(o)). We confirm this in the e-mail that delivers the licence. Until the licence has been sent to you — for example because you have not yet sent us the fingerprint — you may withdraw within 14 days of purchase by writing to info@agatastore.it, and we refund you in full.

The right of withdrawal does not apply to purchases made as a professional or business.

If you are a consumer, you have the legal guarantee of conformity for digital content (Italian Consumer Code, art. 135-octies and following): if the app does not work as described on the product page, write to us and we fix it or, if that is not possible, refund you. For professionals and businesses, the terms of sale apply.

The licence ends if you breach its terms: in that case the app must be uninstalled. The other terms of sale are those of the Terms and conditions; for anything this licence does not cover, Italian law applies and, for consumers, the courts of the place where they live.
